Terms and Conditions

These terms and conditions outline the rules and regulations for the use of Hilario Photography's Website, located at https://hilario.co.uk.

It is agreed that the following terms form an integral part of this contract and that no variation or modification to the contract shall be effective unless accepted by all parties in writing.

1. License: Unless otherwise stated, Hilario Photography and/or its licensors own the intellectual property rights for all material on Hilario Photography. All intellectual property rights are reserved.

You must not:

  • Reproduce, duplicate or copy material from Hilario Photography unless agreed otherwise

  • Sell, rent, or sub-license material from Hilario Photography

This Agreement shall begin on the date hereof.

2. Booking Fee: A non-refundable booking fee is required when the client signs this contract. Dates are only reserved when the booking fee is paid. The balance owing is due for payment 14 days before the event date. In the event of cancellation, a cancellation charge will be made as follows:

a. Cancellation giving a minimum of 6 months’ notice – 50% of the full contract price will become payable.

b. Cancellation within 6 months of the event date – the full amount of the contract price will become payable. The wedding photography is only considered booked after a signed contract has been received by the Photographer and the booking fee stated has been paid. Please note that an email confirmation will always be sent to the client after the Photographer has received the signed contract and booking fee. Unfortunately, it is not possible to hold a date without receiving a signed contract and booking fee.

3. Adverse Weather: In the event of rain, snow, strong winds, or any other adverse weather conditions on the day, the Photographer will make any necessary changes to the photographic session at their sole discretion. However, the Photographer, with the cooperation of the client, will give their best effort to produce coverage of the event within the time allocated. In this case, the client will seek a suitable room or location in which the photographs can be taken.

4. Coverage: The Photographer will not be held responsible for any lack of coverage caused by the client or any of its parties not being on time, or by the Church, Registry Office or other licensed place imposing any restrictions on the Photographer. The photographer shall be granted artistic license in relation to the poses photographed and the locations used. Although every effort will be made to comply with the Client's requirements, the photographer’s judgement regarding the location, poses and number of photographs taken shall be deemed correct. For bookings involving a church ceremony or at certain other venues, photographers ́ movements are sometimes restricted by the minister or official in charge: photographing of parts or even all of the ceremony may be restricted or prohibited, as may the use of artificial lighting. The photographer cannot accept responsibility for limited coverage in such cases.

5. Sole Rights: Hilario Photography shall be the sole professional photographers at the venues specified unless agreed otherwise.

6. Force Majeure or Act of God: The due performance of this contract is subject to alteration or cancellation by the Photographer due to any cause beyond their control. In the unlikely event of injury or sickness, loss or theft, total or partial photographic failure the Photographer’s liability shall be limited to a full refund of all monies paid to them under this contract. Your statutory rights are not affected.

7. Limitation of Liability: The Photographer agrees that every effort will be made to provide high-quality photographic service. In the unlikely event that a catastrophic failure should occur to the Photographer’s equipment or that the Photographer is for any reason unable to provide the client with the agreed photographic service and/or products, or if the quality of the services and/or products is deemed to be substandard by the client, the Photographer and client agree that the Photographer’s liability shall be limited to a full refund of all monies paid to them under this contract. Neither party shall be liable for indirect or consequential loss for any reason.

8. Copyright: The copyright of all photographs produced is retained by Hilario Photography. Illegal copies of photographs must not be made by any means, under the terms of the Copyright, Designs and Patents Act 1988. Original files will remain the property of the Photographer, who reserves the right to use any images for promotional purposes without further need for permission of the subject or client.


9. Data Privacy: Your information will not be shared with any third parties. Information given will be safely stored as a digital copy on Hilario Photography's password-protected devices. We will delete any personal information within 12 months of the supply of work.
